TERMS OF USE

These Terms of Use (“Terms”) govern your participation as a listing member or signing agent (“Signing Agent,” “Member,” or “You”) on HireNotary.com (the “Website,” “Platform,” or “Service”).

By purchasing a listing, creating a profile, maintaining a membership, or accessing any portion of this Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

If you do not agree, do not purchase or use the Platform.

1. Nature of the Service – Platform Access Only

HireNotary.com is an online advertising directory that allows Signing Agents to create listings so that escrow companies, title companies, lenders, and members of the public may independently locate and contact them.

You are purchasing access to our online advertising platform only.

You are NOT purchasing:

Guaranteed work
Guaranteed signings
Guaranteed referrals
Guaranteed visibility
Guaranteed income
Lead generation services
Employment
Agency representation
Business coaching
Marketing services beyond listing access

We provide platform access only.
What you do with that access is entirely up to you.

Your results depend solely on:

Your activity level
Your responsiveness
Your qualifications
Your pricing
Your market
Local demand
Competition
Broader economic conditions

We do not control market conditions or client decisions.

2. No Guarantee of Work or Results

You expressly acknowledge and agree that:

The Platform does not assign, distribute, or manage signings.
We do not guarantee you will receive any phone calls, emails, or assignments.
We do not guarantee listing visibility.
We do not guarantee search placement.
We do not guarantee client contact.
We do not guarantee income of any kind.

Membership is an advertising opportunity only.

Your success is entirely dependent on your own effort and market conditions.

3. Eligibility Requirements

To maintain a listing, you must:

Be at least 18 years of age
Be a currently commissioned Notary Public in at least one U.S. state
Provide accurate and truthful information
Comply with all applicable state and federal laws

We reserve the right to remove listings that are fraudulent, misleading, expired, inactive, or non-compliant.

4. Accuracy of Listing Information

You are solely responsible for all information in your listing.

You agree that your listing information is:

Accurate
Current
Complete
Lawfully obtained

You must immediately update your profile if any information changes, including:

Commission status
Contact information
Coverage areas
Fees
Credentials

We are not responsible for inaccurate, outdated, or incomplete listings.

5. Independent Contractor Status

You acknowledge and agree that:

You are an independent contractor.
No partnership, joint venture, employment, or agency relationship exists.
We do not control your fees, conduct, scheduling, or business operations.
You are solely responsible for your taxes, insurance, and compliance.

6. Strict 30-Day No-Questions-Asked Refund Policy

We offer a 30-Day No-Questions-Asked Refund Guarantee.

If you are dissatisfied for any reason whatsoever, you may request a refund within 30 calendar days of your initial purchase date.

During the first 30 days:

You may request a refund for any reason.
No explanation is required.
No justification is required.
No proof of dissatisfaction is required.

To request a refund, you must email notaryservice@HireNotary.com within 30 days of purchase.

If requested within 30 days:

Your membership will be canceled.
Your access will be revoked.
A refund will be issued to your original payment method.

7. No Refunds After 30 Days – No Exceptions

After 30 calendar days from the date of purchase:

ALL SALES ARE FINAL.
NO REFUNDS WILL BE ISSUED.
NO PARTIAL REFUNDS.
NO PRORATED REFUNDS.
NO EXCEPTIONS.

This applies regardless of:

Usage or non-usage
Lack of activity
Market conditions
Lack of calls
Dissatisfaction
Financial hardship
Relocation
Illness
Business closure
Misunderstanding of the service
Failure to log in
Failure to update your listing
Any other reason whatsoever

After 30 days, your purchase is final.

By purchasing, you agree to this policy in full.

8. Prohibited Conduct

You agree not to:

Misrepresent your credentials
Provide false or misleading information
Use the Platform for unlawful purposes
Harass or spam other users
Upload unauthorized copyrighted content
Collect data improperly

Violation may result in immediate removal without refund.

9. Indemnification

You agree to indemnify, defend, and hold harmless HireNotary.com and its owners from any claims, damages, liabilities, losses, or expenses arising from:

Your listing
Your notarial acts
Your signing services
Your legal compliance
Any dispute between you and a third party
Your violation of these Terms

10. Limitation of Liability

To the fullest extent permitted by law:

HireNotary.com shall not be liable for:

Lost profits
Lost business opportunities
Lost income
Client disputes
Listing visibility issues
Platform downtime
Indirect, incidental, or consequential damages

Your sole remedy for dissatisfaction is to discontinue use of the Platform or request a refund within the 30-day refund period.

11. Termination

We reserve the right to suspend or terminate access at our discretion for violations of these Terms.

Termination due to violations does not entitle you to a refund.

12. Governing Law

These Terms are governed by the laws of the State of California.

All disputes shall be resolved exclusively in California courts.

You consent to jurisdiction in California.

13. Entire Agreement

These Terms constitute the entire agreement between you and HireNotary.com regarding use of the Platform.

No oral statements, marketing materials, or representations modify these Terms.
